Frequently asked questions
How do the 2026 rules affect an application?
Several changes take effect from June 2026: catering staffing is calculated department-wide at 3 full-time local employees per 1 imported worker (3:1), the local open-recruitment period extends to six weeks, and pay must reach the industry median (effective 22 June). Review the new thresholds before applying; see our detailed guide to the seven measures.
What happens if an employer misses the in-person job fair?
Catering kitchen and floor-service roles under tier-two review must attend an in-person job fair every two weeks during the six-week local-recruitment period, as arranged by the Labour Department; failure to attend may lead to rejection. Other roles follow the basic four-week period and case-specific notices.
What is the Enhanced Supplementary Labour Scheme (ESLS)?
ESLS lets Hong Kong employers apply to import workers for vacancies when suitable local candidates genuinely cannot be recruited. It is a main lawful route for sectors such as catering, hotels and retail. Workers use the standard employment contract and pay must meet the Hong Kong market level for the role.
How long does an ESLS application take?
Local recruitment starts on the date specified by the Labour Department: the basic period is 4 weeks; catering kitchen and service-department roles subject to tier-two review require 6 weeks and the required job fairs. Approval-in-principle is assessed case by case after recruitment. Visa applications follow that approval; Immigration normally takes 6 weeks after receiving all required documents. Recruitment, additional documents, approval, visas and arrival are separate stages. No fixed end-to-end arrival time is promised.
How should local-recruitment evidence be prepared?
Employers must first complete the required period of open local recruitment through compliant channels and retain publication, application and interview records as written evidence. Zhigang can check each item against current requirements; the Labour Department decides eligibility and approval case by case.
What does an ESLS application cost?
Costs cover local-recruitment evidence support, application handling, visa processing and optional accommodation. A written itemised quote is provided by sector and headcount, and the assessment is free. See the fee details.
Who arranges worker accommodation?
Imported workers must have suitable accommodation: the employer may provide housing in Hong Kong or the mainland, or workers from the mainland may live in their own mainland residence as the contract states. Employers may arrange this themselves or use the ZHIGANG staff dormitory plan; for housing duties, deduction caps and contract versions, see the housing topic FAQ →.
How are imported-worker contracts and renewals handled?
Workers are hired under Hong Kong's standard employment contract. If both parties agree at expiry, renewal can be handled under the rules then in force; Zhigang provides contract reminders and renewal assistance.
Which sectors may apply?
Catering, hotels, retail, construction and similar sectors can be assessed under the current schemes and role requirements. Care roles follow a split: residential care workers are imported through the SWD Importation of Care Workers Scheme (the Immigration Department expressly defines the scheme's care worker as excluding care assistants, health workers and nurses); health workers must be statutorily registered and nurses must hold a valid practising certificate. See our guide to the care-worker scheme and role differences. Applicable roles, staffing ratios, wages and approval outcomes are decided by the Labour Department case by case.
Is Zhigang licensed?
Zhigang is AOYE Resources' Hong Kong service brand. The Labour Department directory lists the employment agency as Jobs HK Smartlink at Room 219, 8/F, Eton Tower, 8 Hysan Avenue, Causeway Bay, Hong Kong. This page displays licence number 82950; check the current record in the official directory before using the service.
If a role is on the Hong Kong Talent List, can we skip proving local recruitment difficulties?
Yes. The Talent List is the official register of 60 professions across 9 industry segments (2025 review): if the role falls within a listed profession, the employer is exempted from the market supply test under the General Employment Policy (GEP) or the Admission Scheme for Mainland Talents and Professionals (ASMTP) and may file directly without proving local recruitment difficulties; roles paying HK$2 million or above a year get the same waiver. Only the 'prove locals can't be found' step is waived — qualification and salary vetting continue. See the Talent List 2026 explainer.
We already have a mainland candidate in mind — must we go through ESLS?
Not necessarily — route by the candidate's status: mainland Chinese residents file under ASMTP, non-mainland under GEP. Neither has a quota, but both require a relevant bachelor's degree (or equivalent credentials), a definite offer, a role that locals cannot easily fill, and market-commensurate pay. ESLS covers frontline operational roles. A candidate already holding Top Talent Pass or QMAS status needs no employer-filed work visa — hire directly, minding that their renewal is tied to employment in Hong Kong.
The official 2028 gap is 130,000 — does that mean 130,000 import slots?
No. The 130,000 figure is the projected shortfall in the Labour and Welfare Bureau's Manpower Projection Mid-term Update (published 22 September 2026: 2028 demand of about 3.53 million minus supply of about 3.40 million) — not an import quota; without input measures the gap would exceed 300,000. Each admission channel has its own eligibility, quotas and vetting, with no direct conversion from the gap figure.
