ESLS 3:1 Ratio Explained (Restaurant Employer Edition)

Bottom line: From 16 June 2026, any ESLS application that receives an initial screening notice from the Labour Department must meet a 3:1 ratio for kitchen (chu pin bu) and service counter (lou mian bu) positions in the catering industry — for every 1 imported worker in that department, the employer must already and continuously employ 3 full-time local employees in the same department. The ratio is calculated by all positions in the department, part-time staff do not count, and remainders are not rounded up. Other industries remain at 2:1 for now.

Which positions are covered

  • Kitchen (chu pin bu): Cooks, junior cooks, BBQ chefs, catering preparers, bar supervisors, etc.
  • Service counter (lou mian bu): Waiters, service counter supervisors, receptionists, cashiers, etc.

(Full definitions in the Labour Department's "Catering-related Job List"; the cutoff is whether the initial screening notice date is on or after 16 June 2026.)

Worked example

A tea restaurant: kitchen has 5 full-time local staff, service counter has 6.

Department Local full-time Imported workers requested 3:1 requirement Met?
Kitchen 5 2 Needs 6 ❌ Short by 1
Service counter 6 2 Needs 6 ✅ Met

Three remedies if you fall short: ① Reduce the imported-worker request for that department (5÷3 = max 1, no rounding); ② Hire local full-time staff first, then apply; ③ New hires who are qualified local persons with disabilities count at 1:1 (new-rule concession).

Three common mistakes

  1. Counting by position instead of by department — wrong. All positions in the same department are aggregated.
  2. Using part-time staff to fill the quota — part-timers don't count; only full-time local employees are valid.
  3. "Head-counting" with sham hires — the Labour Department verifies the "already and continuously employed" status; nominal or very-short-hour employment is high-risk and can trigger a ban of up to 5 years plus public naming.

My shop isn't a restaurant — does 3:1 apply to me?

3:1 currently applies only to kitchen and service counter positions in catering; other industries remain at 2:1, but the government has signalled it will adjust the second-tier industry list dynamically, so hotel, retail and logistics employers should keep watch.

What about applications submitted before 16 June?

The initial screening notice date governs: applications notified before 16 June continue under the old (2:1) regime.

How do I quickly calculate my quota?

Formula: full-time local headcount in the department ÷ 3, discard remainder. Zhigang offers free quota calculation (see Zhigang quota calculator).
